Key Legal Disclaimer

Sentinel provides early risk signals based on open-source intelligence. It does not provide forecasts, predictions, or financial advice. All decisions remain the sole responsibility of the user.

Non-Predictive Positioning

Sentinel exists to reduce surprise, not to predict outcomes.

Sentinel does not predict prices, dates, or quantities. It does not estimate exact probabilities, guarantee event occurrence, recommend financial decisions, or replace human analysis.

Sentinel is an early warning instrument that detects signals before they become disruptions. It provides lead time information, not predictive accuracy.

Risk Score ≠ Probability

The risk score (0-100) is an internal metric of severity and temporal proximity, not a statistical probability. It indicates how rare a signal is, how close it is to potential impact, and how difficult it would be to react afterward. It does not represent a percentage chance, level of certainty, or probability of loss.

Essential Legal Clauses

1. Public Source Clause (OSINT Nature)

This software operates exclusively on open and publicly available data sources (OSINT). The system does not perform "hacking," does not access private databases without authorization, and does not use illicit means to obtain information. The user acknowledges that the generated report is a consolidation of public data.

This clause reaffirms that the software only automates the collection of data that is already publicly available, exempting the licensor from accusations of system intrusion.

2. End-User Liability Disclaimer

The user is the sole and exclusive responsible party for the use of information provided by this SaaS. The licensor (FazMercado) is not responsible for strategic decisions, financial losses, or illegal acts committed by the user based on the data obtained. Use for purposes that violate local or international privacy laws is strictly prohibited.

Essential to ensure that the licensor is not held responsible if an executive uses the tool for illicit purposes, such as extortion or stalking.

3. As-Is Basis Warranty

Information is provided "as-is." Given the dynamic nature of public data sources, the licensor does not guarantee absolute accuracy, veracity, or constant currency of the data. No indemnification is due for any inconsistencies found in third-party records.

Protects the licensor against lawsuits for "incorrect information," as open-source data may be outdated or incorrect in the original source.

4. LGPD and GDPR Compliance

Data processing performed by this tool observes the principles of the Brazilian General Data Protection Law (LGPD) and, where applicable, the General Data Protection Regulation (GDPR). Processing is based on legitimate interest and data publicity. Processing of sensitive data for discriminatory purposes is strictly prohibited.

As the service serves global executives, both Brazilian (LGPD) and European (GDPR) laws are cited.

5. Intellectual Property and Reverse Engineering Prohibition

The software, algorithms, and search methods are the exclusive intellectual property of the licensor. Any attempt at reverse engineering, mass data extraction for resale (scraping the SaaS), or sharing access credentials with unauthorized third parties is strictly prohibited.

Protects the source code and methodology of the system.

What Sentinel Does NOT Do

Sentinel explicitly does NOT:

  • Predict prices, dates, quantities, or outcomes
  • Estimate exact probabilities
  • Guarantee event occurrence
  • Recommend financial decisions or trading strategies
  • Replace human analysis or professional judgment
  • Provide forecasts or predictions
  • Offer financial advice

If something appears to be a prediction, it is incorrect in the product.

What Sentinel Does

Sentinel provides:

  • Early detection of weak signals
  • Minimal reliable correlation across multiple independent sources
  • Selective interruption when meaningful signals are detected
  • Reduced surprise by shortening reaction time
  • Reaction time advantage through early signal detection

In technical terms: lead time information, not predictive accuracy.

Prohibited Language

Sentinel never uses language such as:

  • "will happen"
  • "is expected to"
  • "forecast"
  • "prediction"
  • "estimated impact in USD"
  • "probability of X%"

Permitted Language

Sentinel uses language such as:

  • "early signal detected"
  • "historically correlated with"
  • "may precede"
  • "has preceded similar disruptions"
  • "indicates rising risk"

Correct example:

"This signal has historically preceded supply disruptions in similar contexts."

Incorrect example:

"This will likely cause a supply disruption."

User Responsibilities

By using Sentinel, you acknowledge and agree that:

  • You are solely responsible for all decisions made based on Sentinel alerts
  • Sentinel alerts are informational tools, not decision-making instruments
  • You will not use Sentinel data for illegal purposes or in violation of privacy laws
  • You will not attempt reverse engineering, data scraping, or unauthorized access
  • You understand that Sentinel does not provide predictions or guarantees

Limitation of Liability

To the maximum extent permitted by law, FazMercado and its licensors shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Decisions made based on Sentinel alerts
  • Inaccuracies or delays in data from third-party sources
  • Events that Sentinel did not detect or alert about
